IMAGINE IT! THE CHILDREN’S MUSEUM OF ATLANTA “RED, WHITE & TRUEBLUE” CONTEST
OFFICIAL RULES
The “Why is your school Red, White & TrueBlue” Contest (the “Contest”) is sponsored by Imagine It! The Children's Museum of Atlanta (the “Museum”) which is located at 275 Centennial Olympic Park Drive NW, Atlanta, GA 30313 and Georgia Natural Gas® (“GNG”) TrueBlue® Schools program (“TrueBlue Schools”). The Contest is governed by these official rules (“Rules”). By participating in the Contest, each entrant agrees to abide by these Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by the Museum and its agents, are final in all respects. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
ELIGIBILITY
The Contest is open to legal residents of Georgia, who are eighteen (18) years of age or older at the time of entry. Children interested in entering the contest must be supervised by an adult during the entry and an adult must appear in the video with the child long enough to indicate that it is supervised by an adult 18 years or older. Employees, advisory committee and board members of the Museum, as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. The Museum has the right to verify the eligibility of each entrant.
Only public or independent elementary schools or schools with grade levels kindergarten, first and second grade in the GNG region are eligible to win. To see the GNG region, visit www.childrensmuseumatlanta.org/suppoort/trueblue. Home schools, child development centers and other non-accredited schools are not eligible to enter.
HOW TO ENTER
[Updated November 18, 2010 to reflect YouTube's decision to decommission Group pages effective December 1, 2010. Contest has been extended until December 5, 2010.]
1. To enter the Contest, each entrant must (i) register for YouTube (if not already registered). Each entrant is solely responsible for complying with the terms and conditions applicable to his/her use of YouTube.

In addition, to enter the Contest, each entrant must submit a video (each a “Submission”) not exceeding :60 between 10:01 a.m. ET on November 1, 2010 and 11:59 p.m. ET on December 5, 2010 (the “Contest Period”) telling why they are inspired by American music and why the elementary school of the entrant’s choice deserves to win one of three cash prizes ($2,500 1st Prize, $1,000 2nd Prize, $500 3rd Prize) to be used for the elementary school’s music program.
3. The school’s name must be included in the submission. A Submission cannot exceed :60 seconds in duration.
4. Each entrant must upload his/her Submission to their YouTube Channel.
5. Each entrant must copy and paste the URL to their video into an email entitled "Red, White & TrueBlue Video Entry". The link to the video must be in the body of the email.
6. The video must be emailed to bharvey@childrensmuseumatlanta.org and lbokovoy@childrensmuseumatlanta.org.
ENTRIES MAY NOT BE FILMED AT THE MUSEUM.
Please remember to respect others' privacy in your Submission. Entrants must have consent from all individuals appearing in or referenced in a Submission.
Submissions must not: (i) contain any copyrighted works without permission of the copyright owner, (ii) contain any false or defamatory statements about any person or third party, (iii) contain any third party trademarks that suggest affiliation with any trademark owner without permission of such owner, (iv) infringe any third-party proprietary or personal rights, (v) contain any profanity, descriptions or depictions of violence, threatening language, (vi) be offensive, inappropriate, indecent, harmful, discriminatory or obscene, (vi) depict any activity, which has the potential to cause or did cause damage to Imagine It! The Children's Museum of Atlanta or Georgia Natural Gas® TrueBlue Schools (viii) depict any act which is dangerous or suggests any person undertake a dangerous activity, in the case of each of the preceding provisions (i) through (viii), as determined by the Museum in its sole and absolute discretion. In addition, all Submissions must be in keeping with the Museum’s image, as determined by the Museum in its sole and absolute discretion. Once an entrant has upload his/her Submission, the Museum (or its designees) will have the right, but no obligation, to review the Submission for compliance with these Rules, and the Museum may disqualify any Submission or remove any Submission from the Contest Website for any reason.
Submissions, in whole or in part, become the exclusive property of the Museum. By entering this Contest, each entrant assigns to the Museum all right, title and interest that entrant may have in and to his/her Submission, including, without limitation, all intellectual property rights and other personal and proprietary rights, without expectation of compensation or acknowledgment (other than the prize awarded as set forth in these Rules). Should that assignment fail or be deemed unenforceable for any reason, the entrant that submitted the entry grants to the Museum (and those acting pursuant to the direction of the Museum) a perpetual, worldwide, royalty-free, irrevocable, fully-transferable license to use, display, reproduce, publish, edit, translate, assign, sublicense, and to otherwise exploit the Submission in any way, including for promotional purposes in any media or manner worldwide or to otherwise use or commercially exploit any information or ideas contained within any Submission. The Museum shall have no obligation to maintain any of the Submissions or information or ideas contained therein as confidential or proprietary. Any individual submitting a Submission hereby waives in favor of the Museum any moral rights, rights of attribution or similar rights the individual might otherwise have in the Submission. Entrants agree that there is no guarantee that the Museum will make use of any rights granted to the Museum in any Submission and any use of a Submission or idea is solely at the Museum’s discretion.
Each entrant submitting a Submission represents and warrants to the Museum that (i) the entry information he/she submitted is true and accurate and that the Submission complies with these Rules; and (ii) that his/her right to submit the Submission is not restricted in any way. By entering this Contest, entrant consents to the posting of his/her Submission on the Contest Website and acknowledges that the Submission will be viewed by visitors to the Contest Website and and may be commented upon by viewers for the purposes of the prize award.
The Museum has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. The Museum is not responsible for any Submission being copied from the Contest Website or otherwise appropriated by third parties. In the event of a dispute as to any entry, the authorized account holder of the YouTube account used to enter will be deemed to be the entrant. The “authorized account” holder is the natural person assigned the YouTube account by YouTube. Potential winners may be required to show proof of being the authorized account holder.
SELECTION OF WINNER
After the contest entry period of 5:00 p.m. ET on November 1, 2010 and 11:59 p.m. ET on November 28, 2010, all videos will be reviewed by a Museum panel. Three videos will be selected as finalists. The three videos receiving the most votes via a confidential Survey Monkey survey will be invited to the Museum in January 2011 for the video contest winner announcement and check ceremony.
The three prize finalists will be notified on or about January 5, 2011 through the YouTube messaging system. All three finalists must respond to the Museum within 5 calendar days accepting their finalist position after being notified by the Museum. Each entrant is responsible for monitoring and making accessible to the Museum YouTube channel his/her YouTube account for prize notification or other communications related to this Contest. If the potential prize finalist does not respond to the Museum within 5 calendar days of being so notified, using the YouTube messaging system, or if prize finalist notification is returned as undeliverable, that potential prize finalist shall no longer be consider a potential prize finalist and an alternative prize finalist may be selected from the remaining Submissions according to the judging criteria. The potential prize finalist must comply with these Rules to be confirmed a prize finalist of the prize.
Three prize finalists will be invited to a special check presentation event on a date on or about the week of January 17th. At the check presentation event, the three finalists will be awarded first, second and third prizes for their video.
The potential prize finalist must sign and return any required forms, including, without limitation, affidavits of eligibility, prize finalist’s acceptance of the opportunity to be a potential winner, and liability and publicity release forms to the Museum five (5) days after delivery of the forms. If the potential prize finalist fails to comply with these Rules or fails to return all of the required forms within the time specified, that potential prize finalist may be disqualified, and an alternative prize finalist may be selected from the remaining Submissions according to the judging criteria. The return of the above-mentioned forms within the allotted time shall be solely the responsibility of the prize finalist. The prize may not be awarded if an insufficient number of eligible entries is received.
PRIZE
There are three prize awards. 1st prize is $2,500, 2nd prize is $1,000 and 3rd prize is $500 in cash to be awarded by Georgia Natural Gas® TrueBlue Schools program (“TrueBlue Schools”) to an elementary school music program within the Georgia Natural Gas® customer region.
Further details regarding the use of the cash award will be provided to the potential prize winner by the Museum and TrueBlue Schools upon notification of winning.
Incidental expenses and all other costs and expenses which are not specifically listed as part of the prize in these Rules and which may be associated with the acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the prize winner. This may include expenses, including, but not limited to travel to the Museum
ADDITIONAL LIMITATIONS
The prize is non-transferable. Except as otherwise provided herein, no substitution or cash equivalent of the prize is permitted; however, the Museum and TrueBlueSchools reserves the right to substitute the prize with another of equal or greater value. The Museum is not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting of these Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by the Museum The Museum reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if the Museum determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the Museum’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, the Museum reserves the right to void suspect entries at issue. The Museum is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE MUSEUM AND ITS OFFICERS, TRUSTEES, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT'S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF THE PRIZE. THE MUSEUM DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.
THE MUSEUM AND ITS ADVISORY COMMITTEE, BOARD MEMBERS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
PUBLICITY
Prize winner grants the Museum and its advertising and promotional agencies and providers and those acting under their permission the irrevocable and perpetual right to use their name, likeness, voice, comments, and any photographs or video or audio footage that may be taken for advertising and publicity purposes in any form of media, now known or hereafter developed or perfected, without payment of additional consideration or acknowledgement, except where prohibited by law.
INTELLECTUAL PROPERTY
The Contest, the Rules and all related web pages, content and code are the property of the Museum or authorized third parties. The copying or unauthorized use of any of those materials, associated trademarks or any intellectual property without the express written consent of its owner is strictly prohibited.
